The Mediation Process.
Congratulations! You are taking control of your future and are one step closer to resolution. Mediation saves time, money, and stress, not to mention reduces uncertainty.
Your Mediator, Laura Cox, is a trained impartial, neutral facilitator who will assist you in reaching a mutually acceptable resolution with the other side. Your Mediator will not offer legal advice to any party-- that is counsel's job and they are highly competent-- however, Laura may express her opinion concerning the strengths or weaknesses of a party’s claims. Laura uses a blend of facilitative and evaluative styles, in line with attorney and party expectations, and with the goal of reaching a resolution. Laura does not determine who is right or wrong, but rather works with both sides to evaluate potential risk at trial.
Parties and their counsel will decide whether they want joint or private sessions (in separate breakout rooms on Zoom). Your Mediator will not disclose any information received in private caucus without the permission of the party making the disclosure. No recording of any Zoom session is allowed.
The ground rules of mediation include respect, good faith, and honesty. What you put into the process determines the outcome.
More information will be provided in a comprehensive Agreement to Mediate, including Laura's policy on the use of artificial intelligence to help guide sessions, and if you have any questions or concerns, please let Laura know!
